Termes et Conditions de TMOOV3D

1. Introduction

These terms and conditions govern the use of the TMOOV3D website and, when mentioned or incorporated into a submission, order, invoice or agreement, the 3D design, prototyping, 3D scanning, additive manufacturing, part reproduction, production and other services offered by TMOOV3D.

By using our site or accepting a submission that refers to these terms and conditions, the customer acknowledges having read them.

When specific conditions are included directly in a submission or written agreement, these conditions take precedence in the event of any conflict with these conditions.

Nothing in these terms and conditions is intended to limit the rights granted to consumers by applicable law.

2. Submissions and Orders

The prices, quantities, materials, deadlines, specifications, design stages and other conditions specific to a project are those indicated in the submission sent to the client.

A submission becomes an order when the customer accepts it according to the terms indicated by TMOOV3D, including in writing, electronically, by purchase order or by payment of the required deposit.

Unless otherwise stated, any changes requested after acceptance of the submission may result in a revision of the price, delivery time or project specifications.

Applicable taxes, delivery charges, installation fees or other charges are listed separately where applicable.

3. Deposit and payment

A deposit may be required before the start of design, procurement, or production. The amount and payment terms are specified in the quote.

The balance must be paid according to the terms indicated on the quote or invoice.

Net 30 payment terms or any other credit terms only apply when expressly granted by TMOOV3D.

TMOOV3D may suspend a project when outstanding amounts remain unpaid, subject to the rights provided by applicable laws.

4. 3D design and client approval

When TMOOV3D creates or modifies a 3D design, the client must provide sufficiently precise information regarding, in particular, dimensions, intended use, interfaces with other components and known constraints.

When the nature of the project allows, a design, prototype or digital representation may be submitted to the client for approval before final production.

Customer approval confirms, in particular, the dimensions, geometry, appearance, and features that can reasonably be verified at the time of approval.

Any changes requested after this approval may be subject to additional charges.

However, this approval does not limit the guarantees or remedies that cannot be excluded under the law.

5. Prototypes and validation

A prototype is primarily intended to validate a design, dimensions, assembly, function, or manufacturing method.

Unless otherwise stated in the submission, a prototype should not be considered equivalent to a final part intended for permanent use.

Modifications may be necessary after testing or validation by the client.

When the performance of a part depends on its integration into a system, machine, vehicle or assembly that TMOOV3D cannot reproduce in its facilities, the final validation may have to be carried out by the customer in their actual operating environment.

6. Additive manufacturing and tolerances

Additive manufacturing has process-specific characteristics, including layer lines, slight variations in texture, color, finish, or dimensions.

The tolerances applicable to a project depend in particular on the geometry, material, manufacturing process, dimensions of the part and the requirements indicated in the submission.

When a precise tolerance or critical requirement is needed, the customer must indicate it before manufacturing so that TMOOV3D can assess its feasibility.

Normal process characteristics that comply with agreed specifications do not, in themselves, constitute a manufacturing defect.

7. Materials

TMOOV3D selects or recommends materials based on information provided by the client and the intended use of the part.

The performance of a material can be influenced by factors including geometry, printing orientation, humidity, temperature, chemicals, UV rays, applied loads, and actual usage conditions.

A material recommendation does not constitute an engineering certification or a performance guarantee for an application that has not been expressly tested or validated.

8. Critical applications and certifications

Unless otherwise specified in writing in the submission, TMOOV3D's services do not include:

  • an engineering certification;

  • regulatory approval;

  • a medical certificate;

  • a professional structural validation;

  • an electrical certification;

  • certification for a pressurized device;

  • or a specific security certification.

The customer must inform TMOOV3D before ordering when a part is intended for an application where a failure could result in a significant risk to people, equipment or facilities.

Additional professional testing, validation, or approval may then be recommended before any use.

9. Customized Products and Parts

A large part of the products manufactured by TMOOV3D are designed or manufactured specifically according to a customer's requirements.

Subject to the rights provided by applicable laws, a custom order generally cannot be cancelled without charge once design, material procurement or manufacturing has begun.

In the event of cancellation accepted by TMOOV3D, work already completed, specially ordered materials and other costs incurred may be billed to the client.

Specific cancellation terms are indicated in the submission when they differ from these conditions.

10. Returns and refunds

Standard non-personalized products may be eligible for return when the conditions set out in the TMOOV3D Return and Refund Policy are met.

Customized products, made-to-measure parts, prototypes and designs created specifically for a customer are generally not eligible for return simply due to a change of mind, subject to rights provided by applicable laws.

A product with a conformity issue or defect must be reported to TMOOV3D within a reasonable timeframe so that the situation can be assessed.

11. Guarantees

No automatic one-year commercial warranty is included with any TMOOV3D products or projects.

When a commercial warranty is offered, its duration, coverage, exclusions, and price, if any, are expressly stated in the quote, invoice, or documents accompanying the product.

A commercial warranty may specifically exclude damages resulting from:

  • from misuse;

  • from an incorrect installation carried out by a third party;

  • of a modification to the part;

  • of an accident or impact;

  • of conditions exceeding the intended use;

  • of an unforeseen environmental exposure;

  • or normal wear and tear.

The guarantees provided by law remain applicable where applicable. These terms and conditions do not, in particular, limit the legal guarantees to which a consumer is entitled under applicable laws.

When an additional paid warranty is sold to a consumer, the information and cancellation rights provided by applicable law are communicated at the time of sale.

12. Delivery

The fees, delivery method and expected delivery times are indicated in the quote or at the time of ordering.

Manufacturing and delivery times are established based on the information available at the time of submission and may be affected by events beyond TMOOV3D's reasonable control, including supply disruptions, transportation problems, or unforeseen circumstances affecting production.

TMOOV3D informs the client when a significant delay is known.

The specific rights applicable to consumers regarding delivery times remain fully applicable.

13. Installation

When installation services are required, their scope must be expressly stated in the submission.

Unless otherwise specified, the manufacture of a part does not automatically include its installation, modification of existing equipment, or any necessary preparatory work at the customer's site.

The client must provide accurate information regarding the installation environment and report any known constraints before the start of the project.

14. Files, intellectual property and reproduction rights

Files, designs, trademarks, logos, models and other elements provided by a client remain the property of their respective owners.

The client confirms that he/she has the necessary rights or authorizations to request TMOOV3D to use, modify or reproduce the elements that he/she transmits.

Ownership and usage rights for 3D models, CAD files, STEP files, meshes, technical drawings or other creations produced by TMOOV3D are determined by the submission or agreement applicable to the project.

Except where a transfer or delivery of source files is expressly provided for, the working files, methods, processes and internal elements used by TMOOV3D to produce a part are not automatically transferred to the customer.

15. Confidentiality and use of projects

TMOOV3D takes reasonable measures to protect files and technical information received in connection with a project.

When a project is expressly identified as confidential, TMOOV3D undertakes not to publicly disclose the confidential information received, except with the client's authorization or when required by law.

Photos, videos, client names, logos or details of a confidential project are not used for promotional purposes without proper authorization.

A separate confidentiality agreement may be signed when the nature of the project requires it.

16. Usage limitation

The client must use the parts in accordance with the agreed use and the recommendations communicated within the framework of the project.

TMOOV3D cannot be held responsible for any problem directly attributable to a modification made without its approval, to a use manifestly different from that communicated during the design or to essential inaccurate information provided by the client, subject to liabilities which cannot be limited or excluded under law.

For commercial clients, any additional limitations of liability applicable to a particular project may be specified in the quote or in a separate agreement.

17. Website Content

The content of the website www.tmoov3d.com is provided for informational purposes and may be modified to reflect changes in TMOOV3D's services, equipment, materials and capabilities.

Photographs and project examples illustrate achievements or capabilities and do not automatically constitute a promise that every project can be completed to the same specifications, price, or timeframe.

Unless otherwise indicated, the original texts, images, graphic elements and content of the site belong to TMOOV3D or are used with the permission of their owner.

18. Protection of personal information

The collection, use, storage and protection of personal information are governed by the TMOOV3D Privacy Policy.

The tracking technologies and cookies used on the site are also described in the site's applicable consent tools and policies.

19. Modification of these conditions

TMOOV3D may update these terms and conditions for future transactions.

Modifications do not retroactively change the terms of an order already concluded, except by agreement between the parties or where permitted by law.

The date of the last update is indicated at the top of this page.

20. Applicable Law

These terms and conditions are governed by the laws applicable in the province of Quebec as well as by applicable Canadian federal laws.

For consumers, nothing in these terms and conditions limits the rights, remedies or rules of jurisdiction granted to them by applicable mandatory law.

For business-to-business relationships, unless otherwise agreed in writing, the parties agree that any dispute relating to an order or service from TMOOV3D will be submitted to the competent courts of Quebec.
